Tobacco Compliance Checks

Fargo and West Fargo Police Departments, with assistance from Fargo Cass Public Health, conduct tobacco compliance checks. When an establishment fails, the following penalties apply:

Fargo:
The 1st failure in a one year time period – one year probation.
The 2nd failure in a one year time period – 3 day suspension of the tobacco license.
The 3rd failure in a one year time period – 10 day suspension of the tobacco license.

West Fargo:

With no approved training program:

1st offense----written warning, 12 month probationary period.
2nd offense---3 day suspension of license (if within probationary period).
3rd offense---10 day suspension of license (if within probationary period).
Subsequent violations within probationary period result in a 30 day license suspension.
If any sales occur during a suspension period, the license will be suspended for the full probationary period.

With an approved training program:

1st offense---written warning, 12 month probationary period.
2nd offense---$250 administrative fine (if within probationary period).
3rd offense---$250 administrative fine (if within probationary period).
4th offense---3 day suspension of license (if within probationary period).
5th offense---10 day suspension of license (if within probationary period).
Subsequent violations within probationary period result in 30 day suspension.

September 12, 2011

In Fargo, 41 businesses were checked with two failing.  In West Fargo, 12 businesses were checked, with two failing.
 
Failed in Fargo:
West Acres All Stop, 3441 13th Avenue SW – 2nd failure in 12-month period.
Stop-n-Go # 436, 204 42nd St. S. – 1st failure in 12-month period.

Failed in West Fargo:
Sooper Stop, 620 Sheyenne St. – 1st failure in 12 month period.
Eagle Run Crossing, 3210 Sheyenne St. – 1st failure in 12 month period.

June 13, 2011-Cass County

On Monday, June 13th the Cass County Sheriff’s Department, with assistance from Fargo Cass Public Health, conducted tobacco compliance checks in Cass County.  Eleven businesses were checked with three failures.

Failed in Cass County:
Cenex, 102 Langer Avenue S., Casselton
Schlagel Oil, 703 Front Street, Casselton
Tower Travel Center, 101 Maiden Lane, Tower City

A tobacco compliance failure in Cass County is considered an infraction and the penalty is imposed by the court.

June 6, 2011

In Fargo, 38 businesses were checked, with five failures. In West Fargo, eleven businesses were checked with one failure.

Failed in Fargo:
Bjornson’s, 734 N. University Dr. – 1st fail in 12-month period
Stop-n-Go # 430, 301 10th St. N – 3rd fail in 12-month period
Stop-n-Go # 426, 1901 N. University Dr. – 1st fail in 12-month period
Stop-n-Go # 428, 1462 N. Broadway – 1st fail in 12-month period
Stop-n-Go # 429, 2701 S. University Dr. – 1st fail in 12-month period

Failed in West Fargo:
RJ’s Tesoro, 2125 Sheyenne St. – 2nd fail in 12-month period.

January 24, 2011

In Fargo, 62 businesses were checked, with three failures. In West Fargo, eleven businesses were checked, with one failure.

Failed in Fargo:
Hornbachers Gas Mart, 1532 32nd Ave S – 1st fail in 12-month period.
Stop-n-Go #430, 301 10th St. N – 2nd fail in 12-month period.
Cenex Petro Express, 2921 N. Broadway - 1st fail in 12-month period.

Failed in West Fargo:
RJ’s Tesoro, 2125 Sheyenne St. - 1st fail in 12-month period.
